Rental Properties at Monarch View

At the previous homeowner meeting in July, interest was expressed in changing
our covenants to prevent new rental properties within the subdivision.
According to our lawyer, legal precedent shows that courts side with individual
homeowners if home associations try to change covenants that add "additional
burdens or restrictions" without signed consent of 100% of the lot owners
within the subdivision. Restricting the existing right to rent property would
add a "new burden" because it "specifically prohibits what original
covenants permitted."
We currently have three rental properties, so unanimous consent to this change
is not likely. Therefore, the Board will not proceed with this at this time.
